– Pendergrast v. Matichuk, 186 Wn.2d 556, 379 P.2d 96 (2016). In this matter, Mr. Lee prevailed in a jury trial on claims of trespass and timber trespass under RCW 64.12.030, which resulted in an award of damages totaling $8,510 in economic damages, and $115,000 in non-economic damages. On appeal, the Washington State Supreme Court upheld the awards, and Mr. Lee also successfully secured application of the statutory right to treble damages under Washington’s timber trespass statute to the $40,000 in non-economic damages awarded by the jury for this claim.
– Amalgamated Transit Union Legislation Council of Wash. State v. State, 145 Wn.2d 544, 40 P.3d 656 (2002). In this declaratory judgment action, Mr. Lee prevailed at trial and on appeal to the Washington State Supreme Court, in establishing that legislation repealing the Washington state motor vehicle excise tax and setting motor vehicle license tab fees at $ 30 did not, by implication, repeal a statute authorizing local municipalities to levy a special excise tax on the value of motor vehicles for the use for public transportation.
– Four S Investments U.S., Inc. v. Jasbir Banwait, et. al, Cause No. 11-2-02589-2 (Superior Court State of Washington, Whatcom County). Mr. Lee represented the plaintiff in this matter which arose out of plaintiff’s sale of agricultural blueberry property in which the principal defendant acted as the real estate agent for the buyer. Mr. Lee prevailed in a jury trial and established claims of violation of the Washington State Consumer Protection Act, negligence, breach of contract and fraud, with an associated award of principal damages for $178,043.98 and enhanced damages of $25,000, and prejudgment interest and attorneys’ fees and costs.
